The claimant in this instance claimed that he is an unsophisticated investor who sought securities that would ensure capital preservation, retirement stability, and profitable growth. The claimant claimed that because he was beginning to make money during their relationship, he was really happy. The accounts started losing money in 03/2000.

The claimant asserts that he regularly viewed his portfolio on his computer and communicated with the financial advisor about the losses in the account. He claimed that when he called his FA several times to close the account, he was told to hold on to the failing stocks since they would eventually turn a profit.

Financial Advisors often take down their client disputes from FINRA’s Public database through Disclosure Expungement. Even law firms provide expungement services to FAs so that they can hide or remove their client disputes and maintain a clean record. So the lack of any disclosures on BrokerCheck doesn’t necessarily mean that the broker hasn’t had any conflicts in the past.
