Second, on February 7, 2006, the client claims that his financial advisor distorted the annuity that was sold to him by stating that, should he pass away after the anniversary date of the annuity contract, the death benefit of the contract would not be less than the value attained on the anniversary date, regardless of the “ups and downs” of the market. The client also claims that this adjustment would be applied automatically on each anniversary date, but it would never be less than the highest achieved anniversary date value.
