Investigators discovered that between 2004 and 2006, SDP submitted 11 claims to their workers’ compensation insurer, resulting in a significant increase in the company’s premium payments. Authorities allege that Rapczynski ceased paying workers’ compensation premiums on behalf of SDP and created a second entity, New England Construction Resources (NECR).
NECR purportedly employs a small group of construction foremen and supervisors, who are then “leased” for large construction projects. However, investigators contend that NECR does not use or provide insurance for the actual workers on these projects.
Authorities argue that NECR and SDP are, in reality, the same employer. Rapczynski allegedly established NECR with the sole intent of concealing and not disclosing SDP’s workforce and payroll information. Furthermore, it is alleged that SDP employed numerous construction workers annually since 2006, with a substantial annual payroll, all without maintaining a valid workers’ compensation policy.
Rapczynski is accused of intentionally misleading auditors by concealing SDP’s lack of workers’ compensation insurance. These deceptive actions resulted in Rapczynski and NECR avoiding payment of $66,747 in workers’ compensation premiums.
