Dr. William B Weeks- Settlement Agreement In the Matter of Misconduct Allegations.
In order to avoid the delay and expense of further proceedings and to promote the best interests of the public and the practice of medicine, the New Hampshire Board of Medicine (“Board”) and William B. Weeks, MD (“Dr. Weeks” or “Respondent”), a physician licensed by the Board, do hereby stipulate and agree to resolve certain allegations of professional misconduct now pending before the Board according to the following terms and conditions:
- Pursuant to RSA 329:17, 1; RSA 329:18; RSA 329:18-a; and Medical Administrative Rule (“Med”) 206 and 210, the Board has jurisdiction to investigate and adjudicate allegations of professional misconduct committed by physicians. Pursuant to RSA 329:18-a, III, the Board may, at any time, dispose of such allegations by settlement and without commencing a disciplinary hearing.
- The Board first granted Respondent a license to practice medicine in the State of New Hampshire on June 6, 1990. Respondent holds license number 8374.
- It was brought to the attention of the Board on February 9, 2011, and on June 11. 3. 2010, that Respondent twice violated an alcohol-monitoring contract.
- In response to this, the Board conducted an investigation and obtained information from various sources pertaining to the Respondent’s conduct.
- Respondent stipulates that if a disciplinary hearing were to take place, Hearing Counsel would prove that Respondent engaged in professional misconduct as described at RSA 329:17, VI (b), by the following facts:
- Respondent is a party to a five-year contract that requires Respondent to be monitored for alcohol use.
- Respondent tested positive on or about January 28, 2011, on a phosphatidyl ethanol blood test.
- In June 2010, Respondent self-reported that he had consumed alcohol.
- The Board finds that Respondent committed the acts as described above and concludes that, by engaging in such conduct, Respondent violated RSA 329:17, VI
- Respondent admits that this conduct is sufficient cause for the Board to suspend Respondent’s license to practice as a physician. New Hampshire is a state.
- Respondent certifies that he has read the Settlement Agreement agreement. Respondent understands that he has the right to a formal adjudicatory hearing on this matter and that at such a hearing, he will have the opportunity to confront and cross-examine witnesses, call witnesses, present evidence, testify on his own behalf, contest the allegations, present oral argument, and appeal to the courts. Furthermore, Respondent fully knows the nature, characteristics, and dimensions of these rights, and Respondent understands that by signing this Settlement Agreement, he waives his rights as they relate to the wrongdoing outlined herein.
- When signed by an authorized representative of the Board, this Settlement Agreement becomes an Order of the Board.

Failure to discharge this commitment by a doctor or hospital is essentially a tortious liability.
A tort is a civil wrong (right in rem) as against a contractual obligation (right in personam) – a breach that attracts judicial intervention by way of awarding damages. Thus, a patient’s right to receive medical attention from doctors and hospitals is essentially a civil right. The relationship takes the shape of a contract to some extent because of informed consent, payment of fees, and performance of surgery/providing treatment, etc. while retaining essential elements of the tort.
